Policy Statement

SelfDesign Learning Foundation (SDLF) is committed to protecting all personal information in its custody or control from unauthorized access, collection, use, duplication, modification, disclosure, or disposal.

Definitions

Business Contact Information – means information to enable an individual at a place of business to be contacted and includes the name, position name or title, business telephone number, business address, business email or business fax number of the individual.

Opinion – a subjective assessment or evaluation of a person’s abilities, performance or other characteristics.

Personal Information – is defined as recorded information about an identifiable individual excluding business contact information.

Policy

SelfDesign Learning Foundation (SDLF) will correct or change personal information, where legally possible, in accordance with the Personal Information Protection Act (PIPA), when a learner, parent/guardian, support provider, contractor, or board member believes there is an error or omission and requests a correction. This applies when the individual is unable to correct or change  the information themselves.

Protocol

1. Within five business days of receiving a request from an individual to correct, change, or annotate their personal information, SelfDesign Learning Foundation will correct, change or annotate the information. This will apply unless SelfDesign Learning Foundation is unable to do so, either because the applicant has not submitted adequate proof in support of the requested change or correction, the information is such that it cannot be changed or corrected or the change requires more time to complete.
2. While factual information can be corrected, an opinion usually cannot. In these circumstances, SelfDesign Learning Foundation must annotate the record with a statement to the effect that the applicant does not agree with the opinion given by the other person. If the opinion is based on inaccurate or incorrect information, the person who supplied the opinion may provide an amended opinion.
3. SelfDesign Learning Foundation will advise any third-party service providers also in possession of the information to correct or annotate their records if applicable.
4. Within five business days of changing, correcting, or annotating any personal information, SelfDesign and the service providers, if appropriate, will:

• Inform any other third parties to whom the information was disclosed within the prior year of the change, correction, or annotation.
• Inform the individual in writing that:
  • The information has been changed or corrected,
  • The information has been annotated, or
  • Why a correction is inappropriate or why the proof provided is insufficient or inadequate.

1. When incorrect factual information was used to make a decision directly affecting an individual and the corrected factual information could have influenced the outcome of the decision, SelfDesign Learning Foundation will review that decision.
2. SelfDesign will ensure the change, correction, or annotation will always be recorded with the original record.
